1. Agreement to Terms
By registering for, accessing, or using the xPMO platform ("Service") provided by xPMO Digital Services ("xPMO", "we", "us"), you ("User", "Customer", "you") agree to be bound by these Terms of Service ("Terms").
If you are using xPMO on behalf of an organization, you represent and warrant that you have the legal authority to bind that organization to these Terms, and "you" refers to both you individually and that organization.
If you do not agree to these Terms, you must not access or use the Service.
2. Description of Service
xPMO is a cloud-based enterprise project management platform designed specifically for Saudi Arabian and GCC real estate developers and project management offices (PMOs). The Service includes:
- Project lifecycle management from concept to handover (SG0–SG6)
- Stage gate governance with customizable approval workflows
- Risk, issue, and change management registers
- Cost management including budget lines, commitments, and invoices
- Schedule planning and milestone tracking
- Saudi regulatory compliance modules: WAFI licensing, permit tracking, off-plan sales readiness
- Portfolio and executive dashboards
- Strategy management (Vision, Pillars, Initiatives, KPIs, OKRs)
- Custom Reports and Dashboards
- AI-powered assistant ("Ask X") powered by Anthropic Claude
- Document management and collaboration tools
- RACI matrix and process modeling
- Stage Gate framework builder
3. Account Registration & Eligibility
3.1 Registration Requirements
- You must provide accurate, complete, and current information during registration
- You must be at least 18 years of age
- You must have legal capacity to enter into contracts under Saudi law
- You are responsible for maintaining the confidentiality of your login credentials
- You must notify xPMO immediately at admin@xpmo.com of any unauthorized account access
3.2 Organization Accounts
Each subscription covers one legal entity (company or organization). User accounts are for named individuals only and may not be shared. Multi-tenant isolation is enforced at the database level — no organization can access another organization's data.
3.3 Account Verification
xPMO reserves the right to verify your identity and organization details. We may request supporting documentation for Enterprise accounts or where required by Saudi regulations.
4. Subscription Plans & Pricing
4.1 Available Plans
xPMO offers the following subscription tiers, with pricing in Saudi Riyals (SAR):
- Free Plan — SAR 0/month. 3 active projects, 5 users, 1 GB storage, basic project tracking and stage gate workflow. Always free, no credit card required.
- Starter Plan — SAR 1,990/month (or SAR 1,690/month billed annually). Complete small-PMO platform: 5 projects, 10 users, 5 GB storage, stage gate workflow, risk and issue management, cost and budget tracking, schedule planning, document hub, email support.
- Professional Plan — SAR 4,990/month (or SAR 4,190/month billed annually). Strategic PMO with governance: 20 projects, 50 users, 50 GB storage. All Starter features plus Strategy Module (Vision, Pillars, Initiatives, KPIs, OKRs), Stage Gate framework builder, RACI/Process module, Custom Reports and Dashboards, unlimited Ask X AI assistant, priority support.
- Enterprise Plan — Custom pricing, starting from SAR 12,490/month. Saudi-ready governance-grade platform: unlimited projects and users. All Professional features plus SSO and Audit log, API access, custom branding and white-label, Saudi data residency, WAFI tracker and compliance reports, dedicated success manager, SLA guarantee. All prices are inclusive of 15% VAT as required by ZATCA regulations. Annual billing is charged upfront and provides approximately 15% discount compared to monthly billing.
4.2 Free Trial
New subscribers on Starter and Professional plans receive a 14-day free trial. No credit card is required to start the trial.
After the trial period ends, your workspace enters a 3-day grace period during which you may upgrade to retain access to paid features. After the grace period, your workspace is automatically moved to the Free plan. Your existing data is preserved in all cases.
4.3 Billing & Auto-Renewal
- Subscriptions are billed monthly or annually in advance
- Payments are processed via Moyasar — a SAMA-licensed Saudi payment gateway
- Accepted payment methods: Visa, Mastercard, MADA, STC Pay
- Subscriptions auto-renew at the end of each billing period unless cancelled
- You will receive a renewal reminder 7 days before auto-renewal
- Enterprise plans are invoiced separately per the terms of the individual enterprise agreement and are not auto-charged via Moyasar
4.4 Price Changes
xPMO may change subscription prices with 30 days written notice. Price changes take effect at your next renewal date. Existing customers on previously-published prices may be honored at their original rate at xPMO's discretion.
5. Cancellation & Refunds
5.1 Cancellation
You may cancel your subscription at any time through the billing settings or by emailing admin@xpmo.com. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of that period.
5.2 Refund Policy
- Free trial period: No charges apply.
- Paid monthly subscriptions: Non-refundable after the 14-day trial period, except as required by Saudi Consumer Protection Law (Royal Decree No. M/31).
- Annual subscriptions: Pro-rata refunds may be considered at xPMO's discretion for cancellations made within the first 30 days of each annual period.
- Enterprise plans: Refund terms are governed by the individual enterprise agreement.
5.3 Data After Cancellation
After cancellation, your data remains accessible for 30 days during which you may export it. After 30 days, all data is permanently and irreversibly deleted, except for financial records required by ZATCA, which are retained for 5 years per Saudi tax regulations.
6. Acceptable Use Policy
You agree to use the Service only for lawful purposes. You must NOT:
- Use the Service for any purpose that violates Saudi law
- Attempt to gain unauthorized access to other accounts or data
- Probe, scan, or test the vulnerability of the platform
- Reverse engineer, decompile, or attempt to derive the source code
- Upload or distribute malicious code, viruses, or harmful content
- Use bots or scrapers without written permission
- Resell or sublicense access without a written reseller agreement
- Store content that violates Saudi content regulations
- Use the Service to facilitate financial crimes
- Share login credentials between multiple individuals
Violation may result in immediate account suspension or termination without refund.
7. Data Ownership & Privacy
7.1 Your Data
You retain full ownership of all data you input into the xPMO platform ("Customer Data").
7.2 License to Process
You grant xPMO a limited, non-exclusive license to store, process, and display your Customer Data solely to provide the Service.
7.3 Privacy
Our use of personal data is governed by our Privacy Policy.
8. Service Availability & SLA
8.1 Uptime Commitment
- Professional plan: 99.5% monthly uptime target
- Enterprise plan: 99.9% monthly uptime with SLA credits per individual enterprise agreement
- Free and Starter plans: Best effort, no uptime guarantee
8.2 Scheduled Maintenance
We provide at least 48 hours advance notice for scheduled maintenance, typically performed during 02:00–06:00 AST.
8.3 Force Majeure
xPMO is not liable for service interruptions caused by events beyond our reasonable control.
9. Intellectual Property
9.1 xPMO Ownership
The xPMO platform is owned exclusively by xPMO Digital Services. The xPMO name and logo are registered trademarks with the Saudi Authority for Intellectual Property (SAIP).
9.2 Restrictions
You may not copy, modify, or use xPMO's intellectual property without prior written consent.
10. Limitation of Liability
To the maximum extent permitted by Saudi law:
- xPMO's total liability shall not exceed the amount paid in the 12 months preceding the claim.
- xPMO is not liable for indirect, incidental, special, consequential, or punitive damages.
- xPMO is not liable for loss of profits, data, business interruption, or goodwill.
11. Indemnification
You agree to indemnify xPMO Digital Services from any claims arising from your violation of these Terms or third-party rights.
12. Termination
12.1 Termination by You
You may terminate your account at any time by emailing admin@xpmo.com or via the in-app billing settings.
12.2 Termination by xPMO
xPMO may suspend or terminate your account immediately if you breach these Terms, pose a security risk, or fail to pay fees.
12.3 Effect of Termination
Upon termination, your right to access the Service ceases immediately. Data export remains available for 30 days as described in Section 5.3.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Kingdom of Saudi Arabia. Disputes shall be submitted to the exclusive jurisdiction of the competent courts in Riyadh.
14. Modifications to Terms
xPMO may modify these Terms at any time with at least 14 days notice via email and in-platform banner. Continued use of the Service after the change takes effect constitutes acceptance of the updated Terms.
